Non-compliance With the Home Builder's Manual

Introduction

The Council shall appoint inspectors in terms of Section 19 of the Act for the purposes of inspecting homes enrolled with it. The purpose of inspecting is to reduce the risk of possible structural failures. As such, an NHBRC inspector shall:-

  • do site investigations to confirm compliance with the Home Building Manual
  • Issue a non-compliance if construction is not in compliance with the NHBRC home building manuals and technical requirements.
  • ensure due completion on site of the relevant section(s) of the inspection confirmation form, with signature by the home builder's representative, where available, confirming such inspection.

The registration status of the home builder shall determine the number of inspections necessary to determine compliance with the Home Building Manual in accordance with the priorities given by the NHBRC.

The NHBRC Inspector may do a special inspection, should the NHBRC suspect non-compliance with the Home Building Manual by a home in any particular case.

Non-compliance With the Home Builder's Manual

In the event of an inspector having ascertained non-compliance with the Home Building Manual -

  • such non-compliance shall be communicate to the home builder's representative and shall be reflected in the inspector's report;

  • if the non-compliance is of an administrative nature, the NHBRC will take the necessary disciplinary action against the home builder;

  • if the non-compliance is a technical non-compliance, the inspector shall persue the matter and where appropriate the NHBRC will take disciplinary action against the Home Builder until the necessary remedial action has been undertaken.

The following table illustrates the number of inspections that will be conducted on a house and is a function of the enrolled value.
